Case study: foreign object left in patient’s back during spinal surgery
Paul was left with a large infected wound on his back after surgeons left a piece of medical equipment inside the area during an operation. The wound caused severe pain for Paul and left him significantly disabled. After his case was taken on by the medical law experts at Hospital Negligence Paul was awarded £250,000 in compensation.
Abscess refused to heal
Paul had suffered ongoing pain with his back and underwent procedures to investigate and treat the issue. However following one of the procedures an abscess formed close to the site of the surgery, which became infected and refused to heal.
Paul was taken back to hospital several times to have the abscess drained and cleaned however it remained septic and got larger and larger. Eventually the abscess grew into a significant wound which was extremely painful and left Paul severely debilitated.
Medical equipment found
It was during one of the procedures to treat the infection that surgeons discovered that there was a form of medical equipment buried deep within Paul’s back close to his spine.
The equipment was removed and the wound on Paul’s back began to heal. Skin grafts were carried out it eventually the wound closed up.
Paul and his family were put in touch with the medical law experts at Hospital Negligence for advice about his treatment. We investigated how and why the equipment had been left in his back and whether this had caused the infected wound.
We obtained independent medical evidence that showed that the equipment had caused the septic wound and that it had been left in his back during a previous operation. This type of incident is known as an NHS never event as it should not have occurred if procedures had been followed.
After negotiations we were able to obtain £250,000 in compensation for Paul to help him to cope with his disability.
